Attorney for Timothy Herrington Challenges Evidence Tampering Charge in Ole Miss Murder Case

OXFORD, Miss.–The attorney for Timothy Herrington, Jr., charged with murdering Ole Miss student Jimmy “Jay” Lee and tampering with evidence, says the state is out of luck in filing the new evidence tampering charge.
According to court documents the attorney cites precedent and case law, stating that the state is saying the tampering happened in July 2022, when Lee’s body went missing and the charge was filed in February 2025, after Lee’s body was discovered in rural Carroll County. The documents claim a tampering charge has a two-year time limit.
Herrington was re-arrested after a second indictment two weeks ago. A bond hearing had been scheduled for this week, but was moved.
That bond hearing is now scheduled for Feb. 27.
Herrington, of Grenada, is accused of killing Lee to cover up a romantic relationship between the two, then hiding the body.
He was tried unsuccessfully without a body last year, with a mistrial declared.
