BYHALIA, Miss.–Byhalia Alderwoman Delainer Richmond was not sworn in for her term, but rather signed an affidavit since she was unable to attend the board meeting where board members took the oath of office. Richmond is under arrest, accused with two other people, including former mayor Deborah Tuttle Weathers and her sister Lori Wilson, accused in a burglary last year.

Richmond, who is also facing a previous drug charge and was out on bond, had that bond revoked, reports WREG-TV.

So, she was in jail when the swearing-in happened.

Current Mayor Donald Hollingsworth told the TV station that he is unaware of any law saying that an alderperson had to attend meetings and that Richmond would remain on the board.

She is in her third term as of this week.
