OXFORD, Miss.–Timothy Herrington will not be tried in Oxford for the murder of Jimmy “Jay” Lee, when he goes on trial for a second time in October.
A judge granted his request for a change of venue and that venue will be selected before the trial.
Herrington, of Grenada, successfully argued that pretrial publicity has lessened his chances for a fair trial in the city where some of the incident took place. In his first trial, which ended with a jury that could not make a unanimous decision, a jury was brought to Oxford from Forrest County.
The second trial is scheduled for Oct. 13.
