MONTGOMERY COUNTY, MS (Ben Caxton) — Curtis Flowers, who has been tried six times for the same murders and recently had his latest conviction overturned by the United States Supreme Court, is getting a bail hearing. An attorney for Flowers has asked Montgomery County Circuit Judge Joseph Loper to free Flowers on bail and throw out charges arguing that Mississippi law requires bail after two capital murder mistrials. Flowers’ fourth and fifth trials ended in mistrials. Citing prosecutorial misconduct he is also asking the judge to prohibit a seventh trial. Flowers was sentenced to death after a sixth trial in 2010. Prosecutors say he killed four people in a Winona furniture store in 1996. The bail hearing is set for December 16. Meanwhile, Flowers remains behind bars in Louisville, Mississippi.
